Auto accidents are all-too-common these days, and New Yorkers are no strangers to the risk of being struck by a moving car. Most times when a moving car hits a pedestrian it’s easy to tell who’s at fault – either the driver was driving recklessly, or the pedestrian walked into the path of the oncoming vehicle. But who’s to blame when a pedestrian is hit by a car driving itself?

On March 18 a woman in Tempe, Arizona was struck and killed by an Uber self-driving vehicle. The daughter of the woman killed has retained a personal injury lawyer, underlying the potential high stakes of the first fatality caused by an autonomous vehicle. Early reports state that the pedestrian was outside of the crosswalk when she was hit, and it seems unlikely that even a human driver would have been able to stop in time. Still, the incident has sparked a national debate about the safety of self-driving cars and raising questions of liability.

In this case, both the human safety driver and the company may face legal consequences. The safety driver could theoretically be held responsible for not intervening when conditions became unsafe for pedestrians. Uber could also be held responsible, and may even face criminal charges depending on how the car accident occurred. If you have been involved in an accident involving an Uber, our Bronx auto accident lawyer may be able to help.

Self-driving vehicles are supposed to perform better than human drivers and hopefully reduce the number of motor vehicle fatalities that occur each year. Still, many are naturally questioning the safety of the program and asking whether these cars should be on our roads before they’ve been tested further. Others argue that autonomous cars are still safer than those operated solely by humans. This is, after all, the first death caused by a self-driving car.

Sadly, it’s unlikely to be the last. While you may not have had a run-in with a driverless vehicle, any type of accident that causes injuries should be investigated. Contact Steven I.
